1. Acceptance of Terms

By accessing or using the PropsNVibes platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old to use PropsNVibes. By creating an account, you represent that you are at least 18 years of age and that the information you provide is accurate and complete.

3. Account Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately if you suspect unauthorized access.

4. Platform Role

PropsNVibes is a marketplace that connects renters with independent rental vendors. We are not a party to the rental agreement between renters and vendors. Vendors are independent contractors, not employees or agents of PropsNVibes.

5. Vendor Responsibilities

Vendors must ensure all listed items are safe, clean, and accurately described. Vendors are responsible for timely delivery, setup, and pickup. Vendors must maintain appropriate insurance coverage for their rental operations and comply with all applicable local, state, and federal laws.

6. Renter Responsibilities

Renters must use rental items responsibly and in accordance with the vendor's instructions. Renters are responsible for the safe return of rented items and liable for any damage beyond normal wear and tear. Rental items must not be used for illegal activities.

Important: Renters assume all risk associated with the use of rented items. PropsNVibes is not responsible for injuries, property damage, or other losses arising from the use of rental items.

7. Bookings & Payments

All payments are processed securely through Stripe. Renters are charged at the time of booking. Vendors receive payouts within 2–3 business days after order completion. PropsNVibes charges a platform fee on each completed transaction.

8. Cancellation & Refund Policy

Cancellations made 48+ hours before the event receive a full refund. Cancellations within 48 hours may receive a 50% refund at our discretion. No-shows are not eligible for refunds. Refunds are processed within 5–10 business days.

9. Reviews & Content

Users may leave reviews for completed transactions. Reviews must be honest, relevant, and free of offensive or misleading content. PropsNVibes reserves the right to remove reviews that violate our community guidelines. Vendors may respond publicly to reviews.

10. Prohibited Conduct

Users may not: misrepresent their identity; post false or misleading information; circumvent the platform's payment system; harass, threaten, or discriminate against other users; use the Service for any illegal purpose; attempt to reverse-engineer or compromise the platform's security.

11. Intellectual Property

All PropsNVibes branding, design, and software are our exclusive property. Users retain ownership of their content (photos, descriptions, reviews) but grant PropsNVibes a non-exclusive, royalty-free license to display and promote that content on the platform.

12. Limitation of Liability

PropsNVibes is provided "as is" without warranty. We are not liable for any indirect, incidental, special, or consequential damages. Our total liability for any claim is limited to the amount of fees you paid to PropsNVibes in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless PropsNVibes, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the courts of Los Angeles County, California.
